States Kick as Senate Moves to Amend Electricity Act

The Nigerian Senate has begun moves to amend the Electricity Act, triggering reactions from several state governments who argue that the proposed changes could weaken state-level control over electricity regulation and disrupt ongoing power sector reforms.

The amendment, currently at early deliberation stage, seeks to clarify roles between federal and state regulators following the 2023 Electricity Act which granted states more autonomy to generate, transmit, and distribute electricity within their jurisdictions.

However, some state governments have kicked against aspects of the new proposal, warning that it may recentralize powers previously devolved to them. They argue that such a move could discourage private investors who have already started engaging with state electricity markets.

Senators backing the amendment insist it is necessary to address overlapping regulatory powers, prevent market confusion, and ensure uniform standards across Nigeria’s electricity sector. They also maintain that the reform will strengthen coordination between the national grid and emerging state grids.

Energy experts are divided, with some supporting harmonisation for efficiency, while others fear it could roll back gains made in decentralising the power sector.

Public hearings are expected as the Senate Committee on Power continues consultations with stakeholders, including state governors, distribution companies, and renewable energy investors.
